2. ORDER PROCESS, DELIVERY, PAYMENT AND RETURNS

 

2.1 The online store is under construction and in future will be accessed through this site and will be operated by Wilton Bradley ltd.

 

2.2(i) Any purchases you make through the store are governed by Jacksons terms, conditions and policies, which you can access from this website. Such terms, conditions, and policies, and any obligations or representations associated with such purchases, are solely between you and Jackson


 

Trade Sales. We do not file details of your order for you to subsequently access directly on this website; therefore, please print out these terms and conditions and the order acknowledgement, and confirmation for your own records.

 

2.2(ii) All prices, pictures, and descriptions on this website are subject to change. We maintain no responsibility for inadvertent errors. Please contact us within 30 days regarding price or promotion discrepancies. When you place your order with us, you agree to the price and terms indicated on this website. Price differences related to future or past prices in our store or any other store are not refundable.

 

2.2(iii) Pricing errors will be corrected where and when discovered. Jackson Trade Sales reserves the right to revoke any stated offer, cancel orders, and to correct any errors, inaccuracies or omissions in any stated offer or price, including after an order has been submitted and whether or not the order has been confirmed and your payment processed. If your payment has already been processed for the purchase when your order is cancelled, will issue a credit to the payment method used in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account. If you are not fully satisfied with your purchase, you may return it in accordance with Jackson Trade sales Return Policy.

 

2.3 For items marked as PreOrder: To place your preorder simply add the product to basket and checkout as normal. We will then dispatch the items as soon as the stock arrives with us. Orders with both in stock and preorder items on will be dispatched once all of the items are in stock and

available. Please note that the delivery date on all preordered items is an estimated shipping date only, and although unlikely, may be subject to change. Due to any unforeseen events such as manufacturing delays etc. we cannot guarantee delivery dates for any preordered items. Preorders are sold on a first come first served basis. Preorders are charged when the order is placed. If due to any circumstances your order cannot be fulfilled, we will issue you with a full refund. 2.4 We accept these payment methods: MasterCard, Visa and PayPal (US and UK). The billing address you provide must match the billing address that is on file with the financial institution that issued the credit card. If a credit card authorization fails, we reserve the right to cancel your order

without notifying you.

 

We cannot resolve credit card problems with your financial institution if a credit card is declined. It is your responsibility, as a consumer, to settle credit card problems with the issuing institution.

 

2.5 To cancel an order, please contact us via telephone no more than 1 hour after placing your order. Unfortunately, in busy periods we may not be able to respond to email or contact form cancellation requests before your order has been processed. As we use paperless batch picking, your order may be processed beyond a point where it can be cancelled very soon after it has been placed. If this is the case, you can either refuse the delivery or arrange for the item to be returned.

 

Under the Distance Selling Regulations, consumers have the right to cancel within a time limit of seven working days (not including weekends or bank holidays) after the day on which you receive the goods. If you choose to cancel your order, we require you, the consumer, to pay the cost of

returning the item to us.

 

2.6 You can return any order, as long as the item is still in its original condition, within 30 days and we will happily refund the purchase price. Please find out more about the returns process from our aftersales team Our returns policy is as follows:

 

2.6(i) Unwanted Return: You can return an item as long as the item is still unused and in a resalable condition within 30 days and we will happily refund the purchase price. All returned items should be sent in their original condition and packaging. If an item is returned to us damaged or in an unsuitable condition, we won't be able to give you a refund and we may have to send it back to you (and ask you to cover the delivery costs). All items are inspected on return. We do not accept returns for unwanted items after the 30 days. If you do try to make a return, we may have to send it back to your default delivery address and ask you to cover the delivery costs.

 

When returning items back to us we recommend using a trackable shipping method and keeping hold of your proof of postage in case we need to look at it later on. Product/s that were purchased and delivered with a promotional free gift must be returned with that free gift to receive a full refund for the original item purchased. We reserve the right to deduct the current website price of the Free Gift or promotional item from the purchased item, should the return be delivered without this item included.

 

2.6(ii) Faulty Return: If you are returning an item which is faulty, or you have received an incorrect item, please follow the returns process here. Don’t forget to select the correct returns reason and then a member of our customer service team will be able to assist you further. Your delivery charge

will be refunded in some circumstances, for example, if your entire order was faulty or incorrect.

 

None of the above affects your statutory rights.

 

2.7 Defective Items: A defective item is one that is inoperable but has no apparent damage. If you receive defective merchandise, please call 0345 576 5020 for assistance.

 

2.8 Damaged Items: If an order arrives with obvious shipping damage, please refuse the delivery. If you have accepted delivery and then find shipping damage, please call the fulfiller immediately using the contact information included with the order. Please save all packaging material and paperwork for the order if shipping damage is a possible issue. If you dispose of packaging material or attempt to return the merchandise without contacting the fulfiller, you jeopardize our chances of making a claim, and you may not receive credit for the return.

 

2.9 Limits of Responsibility: We accept no responsibility for userinitiated damage and/or loss of parts incurred during operation or use of a product.

 

2.10 Refunds, Credits and Balances Due: Refunds for returned items will be applied to the original payment method that was used to place the order upon the returned item reaching our warehouse. You will receive an email from us once your refund has been processed. Please note, refunds will be processed within 21 days. The return credit should be reflected on your statement within one or two billing periods, depending on your financial institution's billing cycle.

2.11 (I) International and U.S. Territory Shipping: If you order from a website that provides shipping to international locations or US territories, these shipping destinations are identified at checkout. When you begin checkout, available shipping destinations can be selected from pulldown menus for Region and Country. If your desired destination is not included in the available selections, we cannot ship orders to it.

 

2.11(ii) Christmas Delivery & Returns Policy: Any orders placed between the 1st October and 31st December will be covered under our extended Christmas returns policy. Orders placed within those dates will be eligible for return up until and including the 31st January of the following year.

Christmas returns are subject to our standard return terms and conditions. Order by the 16 th December for delivery in time for Christmas. Orders placed between 15 th December and 4 th January be delivered within 1421 days.

Jackson Trade Sales will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.

 

4.3 Subject to Section 4.1 above, other than as expressly provided in these terms and conditions with respect to specific products and except for the exclusive remedies set out at Section 5, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to

4.4 Subject to Section 4.1 above, Jackson Trade Sales will not be liable, in contract, tort (including, without limitation, negligence), precontract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for

4.6 Notwithstanding the above, subject to Section 4.1 Jackson Trade Sales aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of

incidents attributable to the same clause.

 

4.7 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

5.1 The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.
